Note: Just because I don't have any cases offhand of my friends fined for jaywalking, doesn't mean it isn't against the law. That's putting your arguments into the realm of faith. If those three citations are any indi

Yes. Downloading an album or movie without paying for it is illegal. This isn't in dispute. I think it is in substantial dispute. Can you cite a case of someone in the US being successfully prosecuted for downloading? Note that thi

Obviously it wouldn't work that way. They would arrange to have the incriminating information show up in a way that wasn't obviously linked to the great satan. Then they would have a double-agent positioned to take control once

I guess that means you think non-consensual sex is perfectly fine! If there is one thing anyone else reading along should take away from this discussion, it is that you wrote the above. It perfectly sums up the intellectual rigor of the

I really don't understand why practically no other sites have adopted the slashdot moderation system. It isn't perfect, but it is by far the best moderation system that does not require large time commitments from the site owners

I am soooo going to plagiarize the crap out of that. I have my doubts that it was ever the way you described it. But given these discussions are often rhetorical I don't think that detracts all that much from the concept.

Oh nonsense. You're ignoring the legal system, which is hilarious, because you're talking about a LEGAL construct. Original poster called it an "an unavoidable fact" - that is a statement far in excess of "there

There isn't a single model that will fit all cases. But for your specific example, micropayments. Advertising has kind of starved out the development of micropayment systems over the last decade, but it looks like bitcoin has a chance

Without "legal fictions", what's to keep someone more capable than you to simply take it from you? Laws don't keep people from taking tangible items, they only punish afterwards. The only thing that stops someone from

Even if they win, they've lost; the legal costs alone are silly and aren't paid for by the loser. You could have said the exact same thing when they first went to court and it would have been just as true. But that's why

I think most people would call the rock stars cashing out "talented." That is only a meaningful statement if you also believe the corollary - the people who aren't cashing out are not talented. And if you believe that th

"Legal fiction" is the only thing that gives anyone any control over anything, tangible or otherwise. No, tangible items are inherently controllable because they are rivalrous and excludable. The law just structures how we deal

You probably just left it out, but what was the effect on traffic to the website and as follow-on, sales? I'm thinking the goal was not to have more email subscribers, the goal was probably to sell more stuff via the website.
