   People tend to find bad design jarring, and brand perception suffers as a result. I don't think any site design would survive a mauling like you've described with its credibility intact.

   I thought it might be software patents from the Reuters article but Techcrunch suggests its more about a DMCA-like system

   They've also innovated commercially, this application is a case in point. Online drawing apps have been around for years yet none have thought to integrate paid content like dA have in the form of 'brush packs'.
