If people are googling for a brand which only has one product, then the sale had effectively already been made. This extra "advertising" doesn't actually bring in any extra users, and is only an extra cost for Dropbox.

You appear to be confusing how the law really is with how you wish it were. You just don't get to keep the data file and hide it behind more links. Why not? (A genuine question, btw. I'd be interested in any tested case law.)

If your threat model includes hostile mail relays, you probably shouldn't be using bargain basement VPS providers. Password-reset emails are also easy for an attacker to generate, and no harder for them to intercept than the welcome email.
