Copyright isn't an issue because these ports never contain the actual assets from the games. You usually have to provide your own ROM "ripped from your own copy of the cartridge" (wink wink nudge nudge)

As someone who is colorblind, I recommend testing accessibility with grayscale. If it works in grayscale, it should work for basically all colorblindness types.
