Sure, they have legal rights to do so. However, just because it is legal it does not make it fair (Ref - Sony vs. Geohotz). Punishing for the suspicion of crime, rather than actual crime, just because you are can get away with it, is evil

No it will not. That is a business decision anyways. I dont think this is what the post is concerned about. It is about the dead code, developers leave as commented (for some reason), instead of actually deleting it.
