I can only say that when I'm using a keys-and-arrows editor like Notepad, I can barely think because I'm typing - a - key - at - a - time, but when I'm using vim I'm just thinking and seeing my thoughts.

They certainly have the capability, and they probably use it on some percentage of electronic communication between 0 and 100%. What they're trying to do here is make more of it admissible in court.
