Unfortunately the guy suing the FAA in this case has a pretty bad rep in the hobby, he's the same guy that was flying a delta-wing (same Ritewing platform discussed in the article) in a super busy helicopter corridor in NYC a couple ye

Nope, wrong, not if it's being used in commercial application. The FAA regs that exempt model aviation specifically restrict it to non-commercial activities. When you are in open air and are any distance from the ground, you are in FAA
