One major problem are games which generate code into ram and then execute it. I can't remember if there were any NES games doing that, but I've seen other 6502 based games doing that.

US customers here must mean that if you sell directly to US customers. If you sell via App Store to end users in US, then this is not needed, because Apple will be your customer (Apple Luxembourg for Europeans), not the end user.

I believe those are closed systems not connected to the internet. It still would be better to upgrade them (for easier access to spare parts, knowledge, etc). Otherwise they end up like this French airport which was shut down just few weeks

I think WebVulkan would be great with WebAssembly! The nice thing about those technologies is that they are low-level APIs, which means less rooms for bugs. WebGL, HTML, DOM, and most other web technologies suffer from not being consistent
