That seems fair. If you promise something and fail to deliver, i.e. treat Kickstarter as a store, then you should be liable.

The backers got their money back. And the defendant lost a lot more money than just the restitution. The penalty was harsh, but I don't see why it was unjust. Do you think the plaintiffs should get more money than they deserved?

Perhaps some distinction between domains could be made. The law should/could be interpreted in a way so that a website belongs only on a certain domain. Then access outside of it would be uninvited?
