- lobf 17d agoI think you misread. There is nothing transformative about bittorrent automatically sharing parts of a file you're downloading with your peers.
- tareqak 17d agoThey participated in uploading the files as part of the downloading the torrent from other peers. Their use of the BitTorrent protocol to acquire these files would not have been transformative.
- DANmode 16d ago> They participated in uploading the files as part of the downloading the torrent from other peers. Did they? Are you sure?
- lukan 16d agoNo, only in some instances maybe, they were mostly leechers.

- xethos 16d agoMeta argued in court that yes, they did upload when torrenting > Meta’s reasoning is straightforward. Anyone who uses BitTorrent to transfer files automatically uploads content to other people, as it is inherent to the protocol. In other words, the uploading wasn’t a choice, it was simply how the technology works. https://torrentfreak.com/uploading-pirated-books-via-bittorrent-qualifies-as-fair-use-meta/ https://torrentfreak.com/uploading-pirated-books-via-bittorr...
- DoctorOetker 16d agoI wonder which murderer will use that argument: "it wasn't my choice to shoot the person, it's just intrinsic to the technology that when pulling the trigger, the pistol fires"
- DANmode 16d agoAlec Baldwin
- RickJWagner 16d agoAlmost a good reply, but Baldwin tried saying he did not pull the trigger. ( Nobody believed him. )
- DANmode 16d agoDidn’t follow that shit-show at all - I…don’t think I believe him either!
- DANmode 16d agoSUPER interesting! Especially since it ISN’T an inherent part of a the protocol - just the default of most clients. Wonder if TF skipping pointing that out was intentional!
- DANmode 16d agoHere’s the buried nuance, thanks Tom’s Hardware for picking up the (unusual) slack: https://www.tomshardware.com/tech-industry/artificial-intelligence/meta-defends-using-pirated-material-claims-its-legal-if-you-dont-seed-content https://www.tomshardware.com/tech-industry/artificial-intell...
- whateveracct 16d agoconstantly using tech to launder responsibility. it's disgusting, really.
- esseph 16d ago> They participated in uploading the files as part of the downloading the torrent from other peers. Not necessarily. You can literally turn uploads off and leech torrents.
