While they were not monitoring the channel, it was not a distress call in the first place. Running out of fuel is considered "non-emergency marine assistance". And one is not obliged to respond to it. Only in a life threatening scenario does it count as a distress call where one is obliged to respond, at full speed, if safe to do so.
I dislike lizard people as much as the next guy, but the only thing the crew did wrong was not be monitoring the frequency. Had they heard it, they could still choose to ignore it.
