- pbhjpbhj 2y agoCopyrights only apply when there is copying; independent production is allowed. As it's tort (mostly!), you only have to prove they copied on balance of probability (in jurisdictions I'm familiar with), but you still have to show they copied. Fwiw, copyright is named for "rights", legally allowed/restricted activities. "Copywrite" is the verb meaning to write content for a publication, content being referred to as "copy" in this context.
