So, if I understand this right, the buddy pass would have let him take an empty seat anyway. So wouldn't this make it quite obvious that there are no empty seat

  The buddy pass is only for Southwest flights, so he opted to take another airline.

  Ya, it’s so strange that he thought through a relatively creative (though illegal) solution, only to be caught up by the obvious problem.

    The flight that was full was the southwest one. He then snuck onto a delta flight totally separately.
