Wait, so the Lord of the Rings, being a derivative fan fiction work of mythology, is not copyrightable? Cool beans.
I assume the same is true of all of Disney's works too.

- brookst 3y ago“Derivative work” is a term of art and does not just mean “inspired by” or “influenced by”.
- smeagull 3y agoThe only thing it doesn't meet, is that the things they stole are not copyrightable, because they came too early to be copyrighted. They stole first, and then got protected by law.
- arlcode 3y agoIt depends. The original snow white story as written down by the Brothers Grimm is not under copyright and Disney can't do anything to stop you using it. But lot's of what is associated with that is actually original stuff by the Mouse and therefore (still) copyrighted or trademarked. In particular the well known blue-yellow dress, red bow in her hair, the dwarves appaerences and names are all not part of the traditional fairy tale. Also in that story snow white is a child roughly 7 years old.
- smeagull 3y agoyeah, just because they change things in their fanfic doesn't make it original.
- freejazz 3y agoTolkien isn't using characters from another story. No one has a copyright on good vs evil. It's obnoxious to see these kinds of smarmy takes by people who aren't engaging with the actual copyright caselaw.
- smeagull 3y agoI've seen what comes out of their caselaw, I have zero respect for them.
- kmeisthax 3y agoNo, because the mythology is public domain. Though it would be peak copyright brain - and hilarious - to dissolve the copyright on everything until we can find the first human that ever told a story and trace their lineage down to all their modern descendants.
- krapp 3y agoWhat? The Lord of the Rings is absolutely under copyright. "The mythology" may be public domain but the specific implementation of mythology containing unique characters, plot points, locations and elements created by Tolkien most definitely isn't.
