There is plenty of case law. Mtgox creditors are just really lucky that they’ll be made more than whole because any excess is supposed to go to the equity holders per bankruptcy law. Of course there will always be situations where someone could have invested reduced immediate proceeds more favourably, but it’s easy to say that in hindsight.
