- ronsor 4y agoMemes are usually protected by fair use (parody)
- SahAssar 4y agoOnly if the parody is parodizing the original artwork.
- fundad 4y agoHis parody is ok.
- kadoban 4y agoThey're generally not actually, they just exist because playing wack-a-mole trying to get everyone to take it down is not worth the effort. Fair use is a fairly complicated and nuanced thing, with several considerations for what's allowed and not. It's really not as simple as "oh that's parody", especially when it's...pretty obviously not. Memes are for the most part just plain jokes, not parodies of the work(s) being used.
- EMIRELADERO 4y agoWhile not parody, the 4th fair use factor ("The effect of the use on the potential market") would save memes.
- kadoban 4y agoThat's _one_ of four factors (mostly) in their favor. It's not pick a winner though, it's some vague combination of them all.
