It could be read that way though. Take this excerpt:
> ALL AIRCRAFT, REGARDLESS OF THE STATE OF REGISTRY ... OPERATED ... FOR THE BENEFIT OF A PERSON WHO IS A CITIZEN OF THE RUSSIAN FEDERATION ARE PROHIBITED...
I think you could make a case that an aircraft with a Russian passenger is operating for the benefit of a citizen of the Russian federation. It's a stretch, but not too much of one.
- xg15 5y agoEven if, how would that work in practice though? Should they cross-check the passenger lists of any aircraft that crosses US space and intercept the aircraft if any passenger is a russian citizen?
- kevin_b_er 5y agoUS already demands passenger manifests if you want to fly through the US airspace. So they could know the details.
- Fellama21 5y agoThey are talking about being the pilot in command of an aircraft. The NOTAM says "A PERSON WHO IS A CITIZEN OF THE RUSSIAN FEDERATION ARE PROHIBITED FROM OPERATING TO, FROM, WITHIN, OR THROUGH U.S. TERRITORIAL AIRSPACE". This means they can fly as a passenger but they are not allowed to operate the aircraft unless they are given special permission by the FAA
- unmole 5y agoThe entire order is about ownership and control. Benefit of clearly is about being a beneficial owner.
- LinuxBender 5y agoGiven the confusion the NOTAM created and thus resulting in this discussion one could argue that it might make sense to email the FAA and kindly ask them to reword the NOTAM. They could even join in on the discussion here.
- dmitrygr 5y agoit's been done. they said they have no formal response yet but might soon...
- wolrah 5y agoA regularly scheduled commercial flight on which a passenger happens to be a Russian citizen is not being operated for the benefit of that person. A chartered private jet on the other hand would be. The point of this is to prevent those who would normally fly a personal private jet from just chartering one from an owner elsewhere in the world, or simply continuing to use their personal jet that is legally registered to a charter provider or offshore shell company.
