I am honestly wondering, is this case "fair use"?

  Amateur analysis: for the citizens filming, yes. The copying is incidental, does not harm the market for the work, and the filming is for news/informational purposes. For the police? They may be in violation of copyright law for playing the music without a Public Performance License. I don't see an argument for fair use on their part.
