And these laws need to include the following:
"Citizens may sue at up to $2000 plus incidental fees or costs carried due to dark patterns in a user interface. A lawsuit of this manner is not subject, and supersedes any prior agreements of 'Arbitration' or other means intending a deviation from a court."
- EGreg 7y agoHow about “citizens may sue lawmakers for damages suffered under any law that is ruled unconstitutional”
- dsfyu404ed 7y agoThe red states would go bankrupt paying the people wronged by their constitutionally dark gray (to put it charitably) social policy. The blue states would go bankrupt over the phrase "shall not be infringed". They'd both have to legislate away civil asset forfeiture real quick because it would be a massive liability on the books. It'll never happen but it's fun to think about.
- marcosdumay 7y agoHonestly, I never understood how forced arbitration is constitutional on the US. It seems completely contrary to entire spirit of your Constitution.
- LinuxBender 7y agoCalifornia and Harvard have been fighting it. I believe a bill was passed recently to block some aspects of forced arbitration, but I don't have the link handy.
- pseudolus 7y agoIt arises from the belief that parties should have the freedom to contract as they see fit. Of course, that's just the theoretical underpinning and it doesn't take into account situations where there exists a disproportionate imbalance in negotiating power.
