You're not wrong, that is a maximalist interpretation of the language. Portman has tried to clarify, but there is always a gap between legislative intent and what the rulemaking process (i.e. Treasury) ends up doing with the statute.

This is true of most core loan servicing and deposit management platforms. It is very difficult to get mortgage servicing (in particular) right; the mainframe platforms have decades of honing.

They are almost certainly doing this; question is whether they will file it. FB's noise around this feels very out of character, even for something that's devolved into a personal conflict. They may be truly scared of the update.
