I think his point was the money is not being taken from them forcibly by the state, as is the case with a tax. One could rightly argue that the state should also not be in the lottery business. In this case though there is no coercion.

Why? The reasons for having their own datacenters are either legacy or needing some sort of specialized hardware that is not available at a cloud provider. Mana which is a new pure quant fund uses AWS extensively.

Nah, the SEC rarely actually prosecutes someone (or more correctly works with DOJ to indict them and try them.) It is just how the SEC typically does business. They, (and other regulators, CTFC, SROs) take these little actions all the time

This has to do with the IPO. Ideally the lawsuit will be done before the IPO so there is no uncertainty about future liabilities. Even if Uber won its unlikely that the appeals will be done before Uber wants to IPO.
