I'm sure their agreement had more than one clause. It could very well contain a set of clauses that limits amazon's liability to whatever it collects from customers (in this case, $0).

That is correct. The only difference a GPL license would make is that Growl would be forced to release the source code for any version that they sell. And that they wouldn't be able to sell it through the App Store.

They agreed that their work would be sold for money when they contributed to a BSD licensed project. If they cared, they could release their patches.

Maybe. Forsythe might have some claim to the trademark for "Growl", but things like the Growl Network Protocol should weaken it. Note that the copyright on the code and the trademark on "Growl" are separate issues.

Unless you shell out for a dedicated server, you are sharing the physical machine with other people. The cpu is probably scheduled according to the size of the instance you bought, but you might get the whole thing if your neighbors aren't

A phone and a tablet are two different things, and it makes sense to lock down one in a way that it doesn't make sense to lock down the other. There is no indication that Apple doesn't understand that...
