   I worked at the Apple 5th avenue retail store until April, and there is a document that has to be signed acknowledging that you could lose all your data. That said, it's usually framed as a "this probably won't happen, but just in case"

    The more plausible reason Apple doesn't sue Microsoft is their lack of success in the space. Windows Phone has negligible marketshare and almost certainly loses money given the huge upfront costs of building an operating system and software

    The Galaxy Nexus also isn't in the lawsuit. It only applies to phones no longer in the market (it takes awhile to get to trial), and the trade dress portion of the suit focuses on samsung's android skin, touchwiz, which isn't on the nexus.
