It means discouraging employers using an H1-B when they haven't actually looked at hiring locally, or using an H1-B to hire "cheap" labor because the employee has no leverage and can't really quit as easily as a US emplo

That's kind of the point. It's meant to discourage use unless necessary.

Which industries (non-tech) do you think are doing so many stock buy-backs that if they stopped, they would be paying FAANG level salaries to other H1-B qualifying professions?

Having to provide even a single year of salary up-front (or the 36 month commitment that the parent comment suggested) would be prohibitive to all but the large companies.

This is a good summary of one of my biggest issues with location adjusted salaries. It often seems to be adjusted as if you will be living in that location (and retiring) in that location, which is rarely the case. Yes, in your example both

H1-B applications are not only for tech jobs, and not only for the bay area. There are many other professions which are subject to the same cap, and also have to look outside of the US to fill roles. Nurses are one that come to mind. If all

Does that issue you a new TN (with a 3 year term), while maintaining your status with the previous employer, or terminate your status with your previous employer, with validity only matching the previous expiration date?

That's technically true, but in the future I believe it also means that you have officially been denied entry to Canada, which could come back to bite you in the future (as silly as it is). It also runs the risk of Canada not letting y

If I recall correctly, a petition can only be filed with USCIS for a TN if the individual in question is already outside of the US. Ie, if you are currently within the US on a TN, and looking to switch jobs, you can not file for a new statu

AFAIK if you are a valid green card application with a valid priority date you are allowed to. Considering the backlog for green cards if you're from india/china, there are _tons_ of people in this situation.

I have a couple things wrong with this statement. 1. You picked a profession which has a _shockingly low number_ of positions, and extreme requirements (including citizenship). This is basically a straw-man argument. 2. Astronauts have an i

IIRC even as a non-permanent resident after paying into social security for 40 quarters you are eligible to collect out of it. That doesn't make your point any less valid though.

You want the US government to step in and start dictating to companies what it pays employees in different countries? If that happened, there is an almost-0% chance you get the outcome you want (which seems to be the staff in Pakistan getti

When you're trying to hire someone, "right now" is important. If I want to hire a nurse, and there are no nurses available, I can't afford to wait 4 years for someone to train as a nurse to be available for me to hire. I
