eventually, at the top of the stack, there's some one who asked the question: "how are people going to interact with this?" my hash table is useless if the users can't tickle the UI in such a way as to use the hash table.

This is along the lines of what I was thinking. B&N is at the point where they have to make a last stand. They really have little to lose by pursuing this case which really frees up their legal team politically.

business service isn't that much more expensive than their 20Mbit service. i've been paying $75/month or so and the upgrade to business in my area is $15 more/month or so.

These sorts of laws need to include exceptions for tools that have a non-criminal purpose. Otherwise, a broad reading could include things like NetCat, Curl, and Apache Bench.

It probably has something to do with the group being very small. Sure they turn a lot of traffic, but there's only so much you can do with a group of their size on what I imagine is still a limited budget.
