eBPF was the initial proposal, but Landlock didn't go with it in the end. It's just using a set of regular system calls, the logic behind it is just implemented in C in the kernel as a LSM.

Passing null instead of empty collections is a practice that should be discouraged imho. There is an entire design pattern ("Null object" [1]) that's making the point that you should use a "neutral" object instead.
