   I think it's fair to say that private accounts are probably not covered, but it would be nice for Instagram to make it clear one way or another.

   Or on TMZ.com... (Put another way: the right of publicity will limit commercial use of Instagram photos, at least in the states that recognize it. But TMZ is editorial use, not commercial use.)

   CL allows Google (as a general-purpose search engine) in its TOU. It doesn't allow Padmapper/3taps. And in this context the TOU are enforceable. I wrote about this a few weeks ago here: https://plus.google.com/112961607570158342254/posts/H
