Happened with very old accounts to me as well, where no security questions even had to be entered at the time. The solution was to call Apple Support - they could do it over the phone - I think I had to verify some account details like stre

Pretty sure theft is still theft, even if the door was unlocked. Of course negligence can make it your fault, but even if you find a million dollars on the street - legally - it's not yours.

a patch was released for OS X versions below 10.10 only, so I would assume it should be applied to OS X 10.10: http://support.apple.com/kb/HT6495
