Does it help to have a generic boilerplate contract (jurisdiction-wise) signed by both buyer & seller for such transactions, where the buyer would sign that they have inspected the item to their knowledge and assume full responsibility

Well said. Completely agree with all points except for the conclusion "shooting oneself in the foot". $44MM is chump change for Facebook. They'll happily spend much more if there's a small chance of becoming a gatekeeper
