They could file suit in the US, but this will likely not have any effect as Chinese courts rarely will enforce US Judgements. Filing suit in China would likely have more effective results, but this requires a great deal more time and effort

I'm not sure how this story is relevant, it's well known that human drivers are more dangerous than self driving car. This particular case, while tragic, is not unique. But this isn't a self driving car - it's automated
