Haven’t tried this project yet, but the Ruby interpreter itself starts up very quickly, so I’d expect it to be essentially instant on modern hardware.

The person you're replying to was talking about the Apple II era, when floppies held less than 200k at best. Availability of 2.44 MB floppy drives was an extremely late development, and IIRC rare to actually find in the wild.

IANAL, but it sounds like they're allowed to avoid linking to things, just not punitively. You'd have to sue them to find out whether it's punitive, but that's what discovery is for.
