A patent is a privilege. I have a right to make a living and there are finite ways to do so, if my right to make a living is blocked by others privileges then we don't have much of a free society. Privileges are directly opposed to rights. Either we have all have rights or some have privileges. The real argument is about what kind of society we want to have.
