One does not obtain a warrant and then write software in order to execute it, any more than police obtain warrants and then purchase their breaching equipment, firearms & so forth. Rather, one writes software which is used after obtaining a warrant. And there are plenty of actions for which the government doesn't need to obtain a warrant (I might wish these were fewer, but oddly enough I am not a dictator and consequently cannot make my wishes law).
