State laws still trump that.
Credit card surcharges are prohibited in California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma and Texas.
Thus in those states, the markup will be added/absorbed into normal price and you will pay the credit card markup whether you use a credit card or not. (Some states may still allow explicit cash discounts, but very few merchants use that.)
