You're making a thoughtful point here (though one that I happen to strongly disagree with), so I'm not sure why the downvotes. But anyway, it's worth noting that the publicly switched telephone network, email, SMS, etc. are all wholly compromised and will remain so for the foreseeable future. The reduction in law enforcement snooping ability being contemplated here is tiny by comparison, and they're making an incredible amount of noise about it.
