IANAL and I haven't kept up with what the Fed have said about Bitcoin, but couldn't every Bitcoin service out there fall under banking regulations as a result of ABC v. Aereo? Basically, if it looks like bank/money transfer service/etc, then it is one, regardless of the underlying technology.
