When state legislatures are passing (bought) laws barring municipalities from doing exactly this sort of thing, then no, the relevant body is not, in fact, the owners.
- mseebach 12y agoIn the case we're discussing, that clearly wasn't an issue.
- rosser 12y agoActually, TN is one of the states that has passed laws against municipal broadband. From that article: It’s illegal because Tennessee prohibits municipals from delivering both electric and internet service in any “area where a privately-held cable television operator is providing cable service.” Source: http://broadbandnow.com/report/municipal-broadband-roadblocks/ http://broadbandnow.com/report/municipal-broadband-roadblock...
- mseebach 12y agoClearly they overcame it. Here's a link to an article that may interest you: http://www.salon.com/2014/07/18/comcasts_worst_nightmare_how_tennessee_could_save_americas_internet_partner/ http://www.salon.com/2014/07/18/comcasts_worst_nightmare_how...
- rosser 12y agoYou mean ... this article? The one we're discussing right now?
- mseebach 12y agoYes. Which concerns municipal broadband in Tennessee actually, factually having been build, despite it apparently being illegal.
- rosser 12y agoIt's not blanket illegal. EPB can perfectly legally build out FTTx infrastructure in some cases, but not others.
- davidandgoliath 12y agoIt's worth noting that EPB built their network years ago, the laws are fairly recent if I'm not mistaken (though, I could be extremely wrong).
