Ask HN: Help with CASL – Canadian Anti-Spam Legislation
Hello,
For those who are not familiar with CASL, reefer to http://www.crtc.gc.ca/eng/casl-lcap.htm
(Full text: http://laws-lois.justice.gc.ca/eng/acts/E-1.6/index.html)
I have a few questions, and I'm quite unfamiliar with some legal terms.
My business runs on a dedicated server on Canada (as most of OVH servers). Does CASL applies to me?
(I need to comply to CASL anyway because I'll probably send emails to Canadian addresses (.ca), but if OVH servers are under CASL then more people need to know about this law).
Do sign-up emails (email verification and welcome email) violate CASL?
(The law text lists some exceptions, this one might seem to apply to this:
(6) Paragraph (1)(a) does not apply to a commercial electronic message that solely
[...]
(d) provides notification of factual information about
[...]
(ii) the ongoing subscription, membership, account, loan or similar relationship of the person to whom the message is sent;
This seems to answer my question, but I'd love to hear it in simple English. I'm not a native speaker and I had some troubles before because of my limited understanding.)
Finally, CASL requires the users to consent, and this consent must be "express or implied";
On the sign-up form, the user needs to accept the Terms of Service agreement. Inserting something like "I accept to receive commercial emails from <Company>" on the TOS is sufficient to be implied?
I'm sorry for the bad english. However, this seems to be big and I've seem little or no information about this, so it's worth spreading out the word.
Thanks
