Problem of creating new Internet lies in the infrastructure. We can't just build it upon current network to which NSA (and other agencies) already has an access. It maybe encrypted, but as you pointed yourself, encryption can be broken. So, personally, i can see this new Internet only if there was a new way to send and receive data with less infrastructure overhead as there is now. And that might be possible in the future with stuff like quantum teleportation.
