Actually, it is fair use. It's a derivative work. This is no different than taking a car and doing a video showing everything about it along with a running commentary. Anyways, what's happening is these guys are getting nailed for using unlicensed music as part of their videos. That's a copyright infringement unless it has been paid for YouTube distribution.
