You can interpret the Times's positive spin on the potential agreement as a de facto endorsement, but it is not an endorsement. It's as if the Times said that it's good a new Avengers movie is coming out and the EFF said that the NYTimes gave the movie a positive review without seeing it. Disagree with what the New York Times said, but they don't claim to have seen the agreement.
