This particular incident sounds more like NYPD thinking they have jurisdiction over "people dropping things on pedestrians," which I'm pretty sure they do. They charged the guy with reckless endangerment, not some kind of airspace-related violation. Seems pretty darn reasonable to me, to be honest.
