Actually I believe all 50 states have "recreational use" statutes which provide land owners strong protections: http://www.americanwhitewater.org/archive/article/124/ http://www.americanwhitewater.org/archive/article/124/ I'm not saying we aren't a litigious country but recreational non profits and others are working hard to ensure that it is safe for land owners to allow to/across their land.
