My understanding is hazy, but is it possible that the particular photos taken of objects that are three dimensional could not be under public domain as there was artistic decisions made in capturing the object? A photograph of a painting, meant to re-present that painting with as much accuracy as possible, I think is under the public domain for public domain works.
