Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. Since the USA is not -- legally -- at war and none of the "terrists" the military is pursuing are able to offer asylum, it would not be treason. It would surely be espionage, though. And that's bad enough.
