If that's the case, it will come down to plea bargaining. Disappointing. Too bad it didn't rain away the evidence (even though it was caught on camera).
- anigbrowl 13y agoThat's what the jury would decide, yes (it's up to the prosecutor to prove it, but I know what you meant). It's quite possible that it'll go to trial, he'll be convicted and get some nominal sentence like community service, then the moral/legal question will be the subject of an appeal.
