It's not enough to have a commercial rating, you also need to have a part 135 or part 121 cert for the operation, plane and pilot.
It is however legal to split the rental or fuel costs provided the pilot and passengers have a 'common purpose' in making the flight and it's not advertised as a commercial operation.
