The DoJ doesn't need warrants to produce email and chat evidence in a lawsuit just like they don't need a warrant to produce other kinds of physical evidence from third parties. A subpoena will suffice and always has. People seem to be unaware of how critical subpoenas are to due process, and how long they've been used.
