I disagree with #2. I think that 37signals did the right thing. This issue doesn't just affect 37signals, it affects a lot of other companies. In my opinion, 37signals were obliged to talk about this publicly. If they sent some private mails, a lot of people and companies would still be in the dark regarding the issue. They had a responsibility to call bullshit.
