you sure they have patents for online auctions? I have seen many eBay clones and they were not sued by eBay..

  It isn't worth the legal costs of suing all those small fry. eBay can leave them to bubble along making next to nothing (relatively), competing with each other for the few users who are looking for and managing to find an alternative, and hope they just die out. If one does end up looking like they might have a chance of growing to a size worth caring about, then the legal team will be called to action.
